These Terms of Service (“Terms”) govern your access to and use of victoriasfootwear.com (the “Site”) and any purchase of products from Victoria’s Footwear (“we”, “us”, “our”). By accessing the Site or placing an order, you agree to these Terms.

1. Use of the Site

You may use the Site only for lawful purposes and in accordance with these Terms.
You must not:

  • interfere with or compromise the Site’s security,

  • attempt unauthorized access to servers or systems,

  • scrape, copy, or extract data from the Site,

  • use the Site for fraudulent, misleading, or harmful activity.

2. Products & Availability

Product descriptions (including images, features, and specifications) are displayed on individual product pages.
We try to present colors and details accurately, but variations in device displays may affect how colors appear.

We may change, discontinue, or update products at any time without notice.

3. Pricing & Currency

All prices are shown in USD unless otherwise indicated.
Shipping fees, taxes, or duties (where applicable) may be displayed at checkout or on our Shipping Information page.

Promotions or special pricing may be time-limited and subject to conditions.

4. Orders & Payment

Placing an order constitutes an offer to purchase.
We may accept or decline any order, including (but not limited to):

  • inventory availability,

  • pricing or product description errors,

  • suspected fraud or misuse.

Payments are processed through third-party providers and you authorize them to charge the payment method selected at checkout.

We may request identity or payment verification before accepting an order.

All orders are subject to our Returns & Exchanges policy.

5. Shipping & Delivery

Processing time: We prepare most orders within 1–2 business days (Mon–Sat).
Typical delivery timeframes are shown on our Shipping page or at checkout.

Delivery times can vary due to carrier conditions, peak periods, public holidays, customs/security checks, weather, or other factors beyond our control.

You will receive a tracking link by email once your order has been dispatched.

Title and risk transfer to you upon delivery to the shipping address you provide.

6. Returns, Exchanges & Refunds

Our full return policy is outlined on the Returns & Exchanges page and forms part of these Terms. Key points:

Change-of-mind returns:
You may initiate a return within 14 days of delivery, provided the product is:

  • unused,

  • unworn,

  • in original condition,

  • with all original packaging and tags.

Return shipping for change-of-mind returns is not covered by us.

How to start:
Email support@victoriasfootwear.com with:

  • your order number, and

  • a short description of the reason for return.

You will receive a confirmation email with:

  • return authorization,

  • instructions, and

  • the return address.

Returns sent without authorization may be delayed or rejected.

Condition on return:
Returned items must arrive in the same condition in which they were received.
Products that are damaged, altered, worn, washed, or inadequately packaged during return transit may be refused or subject to partial refund.

Damaged or defective items on arrival:
Contact us within 7 days of delivery with photo evidence.
Once assessed, we may offer a replacement, partial refund, full refund, or other remedy.
We may cover return postage for confirmed defective items.

Nothing in these Terms limits any rights you may have under applicable consumer protection laws.

7. Cancellations

You may request cancellation within 1 hour after placing an order if it has not yet been processed.
Email support@victoriasfootwear.com promptly with your order number.

Once an order has entered processing or shipping, it cannot be cancelled.
You may still submit a return under our Returns & Exchanges policy after receiving the order.

8. Prohibited Conduct

You must not use the Site to:
a. engage in unlawful activity;
b. infringe intellectual property or privacy rights;
c. harass, defame, or harm others;
d. upload malware, spam, or harmful software;
e. attempt to access locked or restricted areas of our systems;
f. interfere with the Site’s performance or infrastructure.

9. Intellectual Property

All text, graphics, logos, icons, photographs, code, and content on the Site are owned by or licensed to us and protected by intellectual property laws.

You may not reproduce, distribute, modify, or reverse engineer any part of the Site without our written consent.

10. User Content (Reviews, Photos, Comments)

If you submit content through the Site (reviews, photos, testimonials, etc.), you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and display such content in connection with our business.

You agree your submitted content:

  • is lawful,

  • does not infringe third-party rights,

  • and you have the rights to publish it.

We may remove user content at our discretion.

11. Third-Party Services

The Site may link to external services (payment processors, carriers, tracking providers, etc.).
We are not responsible for their practices, policies, or content.
Your use of third-party services is governed by their own terms.

12. Warranties & Disclaimers

To the fullest extent permitted by law, the Site and all products are provided “as is” and “as available”.

We disclaim all express or implied warranties, including:

  • merchantability,

  • fitness for a particular purpose,

  • uninterrupted or error-free service.

This clause does not limit any non-excludable rights under consumer protection laws.

13. Limitation of Liability

To the maximum extent permitted by law, we are not liable for:

  • indirect, incidental, special, or consequential damages,

  • loss of revenue, profits, or data,

  • delays or interruptions in Site availability.

Our total liability for any claim will not exceed the amount you paid for the product giving rise to the claim.

Nothing in these Terms excludes liability where it is unlawful to do so.

14. Indemnity

You agree to indemnify and defend us from claims, damages, losses, and expenses (including legal fees) arising from:

  • your breach of these Terms, or

  • misuse of the Site.

15. Governing Law & Jurisdiction

These Terms are governed by the laws of the United States (Delaware law).
You agree to submit to the exclusive jurisdiction of the courts of Delaware, without prejudice to any rights you may have under consumer protection laws in your state of residence.

When we do, we will update the “Last updated” date above.
Continued use of the Site constitutes acceptance of the revised Terms.
